The so-called ‘Right to Be Forgotten’ cases have been provoked by people’s desires to make their own determinations about what personal information is accessible online to others (and when, and how) in a world of data permanence. Legally at stake is how personhood is defined and defended. Thus far, European law has primarily concerned itself with the delisting of ‘data subjects’ from search results and the deletion or anonymization of personal information from and by search engine operators. As a result, (...) personhood has fallen into a kind of legislative void [ 43 ] I argue that this void is engendered by an old friction between the traditional Western secularist cognitive models that have formed the skeleton of Western law and the pulsing flesh of living human subject creation that pushes back against it. At the very least, the digital immortality of our images, voices, words and more, are bringing forth a variety of aspects of our ‘person.’ Meanwhile, religious worldviews have long understood and made use of phenomenological ideas of human becoming and transcendence that are far more congruous with how—even modern secular—people make meaning of their lives and self-creation, and how they think of posthumous existence. Moving through and with some of the most recent thinking in philosophy, anthropology, and cognitive science, I will develop the argument that human subjectivity is not only impossible to limit to the body, but that a radicalized ecological view is the only one that can ‘save’ us. What does it mean to spatialize food? Why combine such an analysis with law, or with signs and spaces? Leveraging Peircean-inspired legal semiotic theory, the spatialized nature of food will serve as a porthole through which a semiotic view of the spatial dimensions of legal experience can be discerned and elaborated. Specifically, case studies of the simultaneously material and immaterial aspects of food will support an analysis that seeks to open avenues of conceptualization regarding categories. The semiotic nature of both (...) food and law will drive a discussion of the “dis-composition” of categories. Though such an effort may appear overly scholarly and far from pragmatic, exactly the opposite claim will be made. Case studies such as that of the “Meatball Wars” will illustrate in plain terms how subject position struggles for space cannot be adequately addressed within traditional disciplinary boundaries. The essay will conclude with a demonstration of how a “discomposing” semiotic approach has the potential to serve as a means of enabling conflict resolution on a broader scale. The overall investigation is motivated by the struggle within academia – seen across the humanities – to rethink traditional foundational assumptions and dichotomies. The argument seeks to ground itself in the interconnectedness increasingly advanced, joining scholars who insist on the importance of anthro-historical context, local particulars, and the impossibility of assuming an objective position that can coolly observe phenomena from “outside.”. In this article, we introduce and demonstrate the concept-metaphor of broken data. In doing so, we advance critical discussions of digital data by accounting for how data might be in processes of decay, making, repair, re-making and growth, which are inextricable from the ongoing forms of creativity that stem from everyday contingencies and improvisatory human activity. We build and demonstrate our argument through three examples drawn from mundane everyday activity: the incompleteness, inaccuracy and dispersed nature of personal self-tracking data; the (...) data cleaning and repair processes of Big Data analysis and how data can turn into noise and vice versa when they are transduced into sound within practices of music production and sound art. This, we argue is a necessary step for considering the meaning and implications of data as it is increasingly mobilised in ways that impact society and our everyday worlds. (shrink)

This study analyses joint decisions. Drawing on video-recorded planning meetings in a workplace context as data, and on conversation analysis as a method, I investigate what is needed for a proposal to get turned into a joint decision: How do people negotiate the outcome of the decision-making processes in terms of whether they indeed comprise new decisions and whether these decisions are really joint ones? This study identifies three essential components in arriving at joint decisions, and discusses two other possible (...) outcomes of decision-making processes – non-decisions and unilateral decisions – as being a direct result of the deployment of the same components. These observations help explain the exact mechanisms involved in approving and rejecting proposals in joint decision-making settings, as well as the ways in which people may negotiate their rights and obligations to participate in decision-making processes. Philosophical interests of Joseph Życiński in the domain of the philosophy of science were focused on the debate concerning the nature of science and philosophy of science that followed the Einstein-Planck revolution in science. The unexpected discovery of the philosophical, extra-scientific presuppositions in science, as well as of the extra-rational factors determining the way these presuppositions are accepted in science were to be explained within the meta-scientific framework. It is the aim of this paper to present ˙ Życiński’s diagnosis of (...) this post-revolutionary situation in the philosophy of science as well as his critique of the metascientific answers to this challenge. The reasons will be given why all those answers are put under two dichotomous rubrics of _internalism_ and _externalism_. It will be also explained how Życiński intends to supersede this false in his opinion opposition with a new concept of the doxatic rationality. However, the details of the metascientific proposal of Życiński will be given only in the subsequent paper. In order to perform the aim of the paper the metatheoretic tools set out by Popper will be used. (shrink)

This article, based on grandparents' narratives collected in a doctoral research project, aims to weave together reflections on childhood, intergenerational bonding, and love. Seven grandmothers and three grandfathers, between fifty-one and seventy-one years old, participated in the research; nine residents of the city of Rio de Janeiro and one of Niterói, Brazil. In addition, narratives were collected from six of their grandchildren, all of them between five and twelve years old, and residents of Rio de Janeiro, Niterói, Brasília and Montevideo, (...) Uruguay. Conducted during the Covid-19 pandemic, our methodological strategy involved interviews conducted on Zoom. Interviews with the adults were conducted individually, and collectively with the children. The themes that emerged in the grandparents' narratives led to reflections on the relationship between adults and children that are emblematic of the conception of childhood found in Walter Benjamin's work, as well as the philosophical anthropology of Martin Buber and the psychoanalysis of Donald Winnicott. The emphasis of the research participants was on affective security, built on the basis of small, everyday gestures, which result in an atmosphere of mutual support between children and adults. From these affectionate encounters between the youngest and the oldest, what we characterize as a “childlike force” is established—an energy field that produces new existential possibilities. The narratives collected here teach us new ways of being adult through our relationships with children: in our encounter with the lifeworlds of the youngest among us, we re-encounter our own deeper sensibilities, and regain the ability to play, to create, and to reinvent ourselves in relearning the joy of beginnings. In this paper, we examine two conceptions of the application of logic and assess their comparative merits. The first is a platonist monist conception that characterizes the logical consequence relation as an abstract relation among propositions. We argue that this proposal, which insists on logic’s topic neutrality, accommodates very well the objectivity of logic. From this perspective, there are no constraints on particular topics. As a result, we have the universality that allows us to go through a wide scope of (...) contexts where logic is applied. In contrast, a non-platonist pluralist conception is examined, and it characterizes the variety of logical consequence relations as concrete, context-dependent in particular cases, and topic-dependent. As will become clear, this conception is particularly well suited to make room for the applications of logic. We conclude that, in order to solve the ontological debate about logic, we need to go beyond its applications. (shrink)

BackgroundPublic Safety Personnel are routinely exposed to human suffering and need to make quick, morally challenging decisions. Such decisions can affect their psychological wellbeing. Participating in or observing an event or situation that conflicts with personal values can potentially lead to the development of moral injury. Common stressors associated with moral injury include betrayal, inability to prevent death or harm, and ethical dilemmas. Potentially psychologically traumatic event exposures and post-traumatic stress disorder can be comorbid with moral injury; however, moral injury (...) extends beyond fear to include spiritual, cognitive, emotional or existential struggles, which can produce feelings of severe shame, guilt, and anger.ObjectiveThis scoping review was designed to identify the extant empirical research regarding the construct of moral injury, its associated constructs, and how it relates to moral distress in firefighters, paramedics, and police officers.MethodsA systematic literature search of peer-reviewed research was conducted using databases MEDLINE, EMBASE, APA PsychInfo, CINHAL PLUS, Web of Science, SCOPUS, and Google Scholar. Included studies were selected based on the inclusion criteria before being manually extracted and independently screened by two reviewers.ResultsThe initial database search returned 777 articles, 506 of which remained after removal of duplicates. Following review of titles, abstracts, and full texts, 32 studies were included in the current review. Participants in the articles were primarily police officers, with fewer articles focusing on paramedics and firefighters. There were two studies that included mixed populations. Most studies were qualitative and focused on four topics: values, ethical decision-making, organizational betrayal, and spirituality.ConclusionPublic safety organizations appear to recognize the experience of moral distress or moral injury among public safety personnel that results from disconnects between personal core values, formal and informal organizational values, vocational duties, and expectations. Further research is needed to better understand moral distress or moral injury specific to public safety personnel and inform training and treatment in support of public safety personnel mental health. Although number sentences are ostensibly simple, familiar, and applicable, the justification for our arithmetical beliefs has been considered mysterious by the philosophical tradition. In this paper, I argue that such a mystery is due to a preconception of two realities, one mathematical and one nonmathematical, which are alien to each other. My proposal shows that the theory of numbers as properties entails a homogeneous domain in which arithmetical and nonmathematical truth occur. As a result, the possibility of arithmetical knowledge is (...) simply a consequence of the possibility of ordinary knowledge. (shrink)

Sexual consent is advocated around the world to reduce sexual assault. The widespread affirmative consent model emphasizes a need for unambiguous consent. In this paper, we contribute to a deeper understanding of how ambiguities in the initiations of sexual activities are routinely solved to achieve consent. Drawing on conversation analytic research on joint decision-making, and a dataset of 80 cases of sexual initiation in contemporary TV-series and movies, we investigate the interactional practices by which sexual activities are presented as consensual (...) and how consent is achieved across sequences of interaction. We found there to be social advantages of synchronous initiation, compared to sequential verbal initiations, which were associated with various social vulnerabilities. These vulnerabilities could however be circumvented by two practices, each of which made use of a distinct combination of verbal and embodied resources. While ambiguities exist, our results oppose the idea of sexual consent as a practically hopeless and awkward endeavor. Instead, consent consists of joint action that is achieved through recognizable and systematic ways. (shrink)

Expertise is commonly viewed as a professionalized competence in a specific field. Expert professional identities are produced and reproduced through professional training and other socialization mechanisms, which work to generate for a specific group of individuals a specific set of expert skills and knowledge. In this paper, I examine participants’ orientations to their distinct expert professional identities from the perspective of deontic authority. Drawing on 15 video-recorded church workplace meetings between pastors and cantors as data, and conversation analysis as a (...) theoretical and methodological framework, I analyze situations where a non-expert participant makes a proposal that the expert participant orients to as reasonable to comply with. Specifically, I demonstrate how the expert participants respond to these proposals with displays of deontic authority, arguably in an attempt to maintain their expert identities in the face of their de facto compliance with the proposals. In these situations, the expert participants are shown to invoke a past decision of their own, a future decision of their own, or a pattern that is beyond both participants’ control. Each of these practices involves the expert participant balancing resistance and compliance by minimally acknowledging the content of the non-expert participant’s proposal, while excluding the non-expert from those who have deontic authority in the matter. In so doing, the expert speaker implies that the non-expert proposal speaker lacks procedural knowledge about the specific matters about which it is relevant to make proposals to experts and access to the distinct experiential perspective that characterizes expert perception of things. It is thus argued that, in this context, the mere claims of deontic authority, produced without any substantial displays of expert knowledge, can serve the maintenance of expert professional identities. The concept of a G‐quartet, a unique structural arrangement intrinsic to guanine‐rich DNA, was first introduced by Gellert and colleagues1 over 40 years ago. For decades, it has been uncertain whether the G‐quartet and the structure that it gives rise to, the G‐quadruplex, are purely in vitro phenomena. Nevertheless, the presence of signature G‐rich motifs in the eukaryotic genome, and the plethora of proteins that bind to, modify or resolve this nucleic acid structure in vitro have provided circumstantial evidence for (...) its physiological relevance. More recently, direct visualisation of G‐quadruplex DNA at native telomeres was achieved, bolstering the evidence for its existence in the cell. Furthermore, G‐quadruplex folded telomeric DNA has been found to perturb telomere function and to impede the action of telomerase, an enzyme overexpressed in >85% of human cancers, hence opening up a novel avenue for cancer therapy in the form of G‐quadruplex stabilising agents. This book seeks to arrive at a better understanding of the relationships between the objective and subjective aspects of time. It discusses the existence of fluent time, a controversial concept in many areas, from philosophy to physics. Fluent time is understood as directional time with a past, a present, and a future. We experience fluent time in our lives and we adopt a temporal perspective in our ways of knowing and acting. Nevertheless, the existence of fluent time has been debated (...) for both philosophical and scientific reasons, thus creating a rift between the subjective and objective aspects of time. Starting from the basic notion of points of view, or perspectives, this book explores the relationships between objective or external time, as it has been conceptualized by science, and subjective or internal time, which is involved in our lived experiences. It establishes a general framework encompassing the nature, structure and mode of existence of points of view, in which the objective and subjective aspects of time can be integrated. The book mainly addresses researchers and postgraduates in philosophy and logic. Additionally, it offers inspiration for physicists and computer scientists involved in the modeling and simulation of complex behaviors for which the representation of internal time should be considered together with the notion of objective, external time. The Arabic original of the ninth-century Kitāb al-Nawāmīs has not been discovered, save for three incomplete chapters. We have access to a fuller version only through a Latin translation, often known as the Liber vaccae, a title derived from its notorious experiments which involve the gruesome slaughter and mutilation of a cow to magically produce a rational animal or bees. Recent research on the Liber vaccae has focused mostly on its reception in medieval and early modern Europe. By contrast, the (...) present article explores the Indo-Arabic tradition to which Kitāb al-Nawāmīs belongs, as a re-orientation of the Liber vaccae established on two levels: textual and theoretical. Section I, on 'Texts and Practices', introduces ʿUyūn al-ḥaqāʾiq of Abū al-Qāsim al-ʿIrāqī, a text on magical practices which contains 26 chapters that correspond to sections in the Liber vaccae, affording us a glance into the Arabic reception of Kitāb al-Nawāmīs and bringing us closer to the Arabic original. The textual connection is established further by highlighting parallels between the experiments of the Liber vaccae / Kitāb al-Nawāmīs and other texts on natural magic, namely Ghāyat al-ḥakīm of Maslama al-Qurṭubī and Kitāb al-Sumūm by Ibn Waḥshiyya. Section II investigates the theoretical bases of the Liber vaccae / Kitāb al-Nawāmīs, by associating its content with the theories of spontaneous and artificial generation in Kitāb al-Tajmīʿ attributed to Jābir ibn Hayyān, Ghāyat al-ḥakīm, Kitāb al-Sumūm and, finally, another work by Ibn Waḥshiyya, al-Filāḥa al-nabaṭiyya. Jābir's and al-Qurṭubī's works have been studied in relation to the Liber vaccae by David Pingree, Maaike Van der Lugt, Sophie Page and William Newman; their findings are re-evaluated here in light of the texts of Ibn Waḥshiyya and al-ʿIrāqī. Paperwork plays a key role in a how institutions accommodate, refuse, or manage disabled people. This article develops modes for reading paperwork that build on each other, beginning with (a) recognizing the institutional pressures at work in shaping bureaucratic practices, then (b) considering how a person's relationship to disability influences how they might encounter these practices, and ultimately (c) noticing how the encounter between disabled/mad people and an institution might create something new, what the author calls archival excess. These methods (...) for reading are in conversation with disability studies, medical humanities, and document studies, and ultimately work toward a goal adapted from the principles of Disability Justice: recognizing the wholeness of disabled subjects in institutional archives. The boundaries, openness and character of the future European society will crucially depend on the degree and scope of identity politics. Religion, culture and nationality remain strong reference frameworks for individuals in their inter-personal but also political relations and tend, in practice, to favour weak rather than strong forms of citizenship. Whether this is a viable model for large and diverse democratic societies is an old debate known primarily from the discussions and theory on multiculturalism. How this debate is played (...) out at European level and especially with respect to the role of religion is illustrated with reference to the ideas of Daniel Cohn-Bendit and Tariq Ramadan, two well-known public figures with a strong commitment to Europe and European identity, albeit from rather different perspectives and outlooks. At the substantive or philosophical level, it appears impossible to resolve the fundamental questions underlying the opposition between liberalism and communitarianism as represented by the two men. The usefulness of a middle-range pragmatic approach insofar as political solutions or societal compromises are concerned is scrutinized for its usefulness. (shrink)

The article reconstructs the premises of the reception of analytic philosophy in jurisprudence and shows that the development of a method for clarifying the meanings of legal concepts is not least connected with the problem of legitimizing law enforcement. The article analyzes H.L.A. Hart’s approach to the problem of correlation between the “letter” and “spirit” of the law in the process of interpreting legal norms. The article argues that the process of interpretation is determined teleologically. In its limit, the interpretation (...) of legal norms presupposes the re-creation of the desired image of society, the reconstruction of such social ontology that is most consistent with the ideal of achieving social welfare. The article examines the collision of the “ideal of order” and the “ideal of justice” as two regulations of law enforcement. The author believes that the interpretation of this collision within the analytical tradition was characterized by a gradual movement from the ideal of “mechanical” law enforcement, which minimizes the creative role of the interpreter, to the ideal of flexible interpretation focused on achieving legal goals in a changing environment. It is noted that, according to analytic approach, a theoretical solution to this conflict was proposed due to the development of the ideas of an “open texture” of law. The author demonstrates that the development of the analytic tradition in jurisprudence has shown that the criticism of language and the interpretation of meanings are not technical tasks, but it presupposes the construction of a metaphysics of law. In this regard, the author concludes: the development of the ideas of the analytic tradition in jurisprudence demonstrates that the thesis about the absence of a positive program in analytic philosophy, put forward in the first article of the discussion, can be challenged. Software vulnerabilities are the root cause for a multitude of security problems in computer systems. Owing to their efficiency and tight control over low-level system resources, the C and C++ programming languages are extensively used for a myriad of purposes, from implementing operating system kernels to user-space applications. However, insufficient or improper memory management frequently leads to invalid memory accesses, eventually resulting in memory corruption vulnerabilities. These vulnerabilities are used as a foothold for elaborated attacks that bypass existing defense methods. (...) In this paper, we summarise the main memory safety violation types (i.e. memory errors), and analyse how they are exploited by attackers and the main mitigation methods proposed in the research community. Resumen Este trabajo intenta esbozar ciertas reflexiones en torno al papel de los afectos en la práctica de la autotraducción en la poesía mapuches. Vemos en el “giro afectivo” una posibilidad de comprender la producción literaria bilingüe de autores mapuches como un proyecto ético de reapropiación lingüística y de transgresión de límites culturales originado en afectos de “pulsión genealógica” que ponen en cuestión la autoridad de la lengua del colonizador, a la vez que resultan en la generación de los llamados (...) “afectos activos”, propios de un aumento del grado de potencia expresiva y de agenciamiento de los sujetos. Para ello trazaremos una cartografía de conceptos de distintos pensadores que han reflexionado acerca de los afectos y la lengua, desde Jacques Derrida a Gloria Anzaldúa, pasando por el ineludible Gilles Deleuze en su estudio de los afectos en la Ética de Baruch Spinoza. Asimismo, pondremos estos conceptos en diálogo con las propias reflexiones de varios de autores mapuches: Liliana Ancalao, Adriana Paredes Pinda, María Teresa Panchillo, Leonel Lienlaf y Elicura Chihuailaf.In this work we wish to analyze the role of affects in self-translation in Mapuche poetry. We see in the “affective turn” a possibility to understand the bilingual literary production of Mapuche authors as an ethical project of linguistic reappropriation and transgression of cultural limits originated in affects of “genealogical drive” that question the authority of the language of the colonizer, as well as resulting in the generation of “active affects”, inherent to the increase of the degree of expressive potency of the subjects. For this purpose, we set out to trace a cartography of concepts by different thinkers who have reflected upon the relationship between affects and language, from Jacques Derrida to Gloria Anzaldúa, as well as the inescapable contributions of Gilles Deleuze on the study of affects in Spinoza’s Ethics. Also, we will link such concepts with the reflections of five Mapuche poets, Liliana Ancalao, Adriana Paredes Pinda, María Teresa Panchillo, Leonel Lienlaf and Elicura Chihuailaf. (shrink)

It has been pointed out that Sensorimotor Enactivism, a theory that claims that perception is enacted and brought about by movement, says very little about the neural mechanisms that enable perception. For the proponents of the predictive approach to Sensorimotor Enactivism, this is a challenge that can be met by introducing predictive processing into the picture. However, the compatibility between these theories is not straightforward. Firstly, because they seem to differ in their stand towards representations: while Sensorimotor Enactivism is said (...) to belong to the non-representational wing of cognitive science, predictive processing has a representational profile. And secondly, because they exhibit different explanatory strategies: while Sensorimotor Enactivism prioritizes the interactions of the embodied agent, predictive processing has internalist commitments. The aim of this paper is to address these concerns and show that a predictive approach to Sensorimotor Enactivism is viable. More specifically, I focus on the Free-Energy approach, a theory that falls within the ballpark of predictive processing. In this paper I argue for the following claims. I argue that both Sensorimotor Enactivism and the Free-Energy approach may be understood for some systems in representational terms. The non-representational reading of Sensorimotor Enactivism is not mandatory and neither is the representational reading of the Free-Energy approach. Sensorimotor Enactivism is, in this respect, compatible with both representational and non-representational interpretations of the FEA. So, the position towards representations of these frameworks should not stand in the way of a predictive approach to Sensorimotor Enactivism. I also show that the Free-Energy approach allows for an account that prioritizes the interaction of the embodied agent with the environment. This is the explanatory strategy followed by Sensorimotor Enactivism. To justify this strategy and following other proponents of Sensorimotor Enactivism, I argue that by referring to the interactions of the embodied agent a better account of the phenomena in question is provided. On this basis, I claim that Sensorimotor Enactivism and the Free-Energy approach are compatible in what concerns their explanatory strategy as well. Thus, making the case for the viability of the predictive approach to Sensorimotor Enactivism. (shrink)

Advocates of interactionism in the ethical criticism of art argue that ethical value impacts aesthetic value. The debate is concerned with “the intrinsic question”: the question of whether ethical flaws/merits in artworks’ manifested attitudes affect their aesthetic value (Gaut 2007: 9). This paper argues that the assumption that artworks have intrinsic ethical value is problematic at least in regards to a significant subset of works: fictional artworks. I argue that, insofar as their ethical value emerges only from attitudes attributable to (...) actual agents, fictional artworks only have extrinsic ethical value. I show that what is at stake for interactionism is whether ethical judgements concerning artists’ attitudes in a context, rather than manifested attitudes, are ever aesthetically relevant. I conclude that, without buying into extreme actual intentionalism, a still controversial theory of interpretation that ties artworks’ meaning to actual artists, interactionism fails to show that ethical flaws/merits are aesthetic flaws/merits. Since its inception, modern anthropology has stood at the confluence of two mutually constitutive modes of knowledge production: participant-observation and theoretical analysis. This unique combination of practice and theory has been the subject of recurrent intellectual and methodological debate, raising questions that strike at the very heart of the discipline. How Do We Know? is a timely contribution to emerging debates that seek to understand this relationship through the theme of evidence. Incorporating a diverse selection of case studies ranging from (...) the Tibetan emotion of shame to films of Caribbean musicians, it critically addresses such questions as: What constitutes viable anthropological evidence? How does evidence generated through small-scale, intensive periods of participant-observation challenge or engender abstract theoretical models? Are certain types of evidence inherently better than others? How have recent interdisciplinary collaborations and technological innovations altered the shape of anthropological evidence? Extending a long-standing tradition of reflexivity within the discipline, the contributions to this volume are ethnographically-grounded and analytically ambitious meditations on the theme of evidence. Cumulatively, they challenge the boundaries of what anthropologists recognise and construct as evidence, while pointing to its thematic and conceptual potential in future anthropologies. (shrink)

One of the main problems of modern rationalistic theories of science is the non-eliminability of the subjective factor in the development of science. Temperate rationalism of Newton-Smith was an attempt to solve this problem. J. Życiński developed his own version of temperate rationalism in which the subjective factor played much more substantial role. In the article I am presenting his specific idea of the personal _commitment_ as a necessary condition for rationalism and science. In the first section I proceed to (...) reconstruct ˙ Życiński’s argument leading him to the conclusion of this epistemological necessity. Next in the section 2 I present his idea of the epistemological uncertainty principle as a consequence of the subjective _commitment_. In sections 3 and 4 I explore axiological and pragmatic aspects of the Życiński solution. Finally, in the section 5 I do compare his temperate rationalism with Newton-Smith’s proposal in the context of the Polanyi’s idea of personal knowledge showing differences in their respective approach to the role of the subjective factor in science and rationalism. _Islamicate Occult Sciences in Theory and Practice_ presents the latest research on Islamic occult sciences from a variety of disciplinary perspectives, namely intellectual history, manuscript studies and material culture.

When a risk is exchanged, the exact value for the minimum price (positive or negative) that the purchaser (investor, or insurer) is willing to pay is given by the certainty equivalent wealth level, which in turn depends on his specific utility function. When this utility function is unknown, then only a sufficient condition on the price can ever be found. This paper provides methods for calculating such a sufficient condition, when only limited information on the utility function is known.

Moral philosophy and psychology have sought to define the nature of right and wrong, and good and evil. The industrial turn of the twentieth century fostered increasingly technological approaches that conjoined philosophy to psychology, and psychology to the natural sciences. Thus, moral philosophy and psychology became ever more vested to investigations of the anatomic structures and physiologic processes involved in cognition, emotion and behavior - ultimately falling under the rubric of the neurosciences. Since 2002, neuroscientific studies of moral thought, emotions (...) and behaviors have become known as – and a part of – the relatively new discipline of neuroethics. Herein we present Part 2 of a bibliography of neuroethics from 2002–2013 addressing the “neuroscience of ethics” – studies of putative neural substrates and mechanisms involved in cognitive, emotional and behavioral processes of morality and ethics. This article examines what constitutes an ethical flaw in artworks and asks which ethical flaws are relevant in determining works. ethical and aesthetic values. I argue that while most of the discussion has simply taken for granted that it is intrinsic ethical flaws that should be taken into account, there are further important differences in the type of intrinsic ethical flaws that artworks display. I identify two different types of ethical defects in artworks, fictional and actual, and argue that this (...) distinction has important consequences for debates surrounding the ethical value of works of fiction. En este trabajo se plantea, en primer lugar, la conveniencia de distinguir en el proceso de la contrastación empirica de hipótesis y teorías entre observación cientifíca y percepción y, en segundo lugar, se muestra como el munda procesado a través de la percepción se erige en base o soporte empírico del conocimiento científico. Una de las consecuencias del trabajo es que Ia tesis de “la carga teórica" de Ia observación ha sido mal planteada, al dar par sentado que esa carga (...) teórica afecta tambien al procesamiento perceptivo de los outputs proporeionados al científico por el instrumental de observación.This paper first suggests that, in analyses of the empirical testing of hypotheses and theories, scientific observation should be distinguished from perception; and goes on to say that the world, as processed by perception, is the basis or empirical foundation of scientific knowledge. This thesis that observation is “theory-laden” has been flawed by its being articulated as applying not only to scientific observation but also to the perceptional processing of the output provided to the scientists by observational instruments.
